REVOL AUCTION USER AGREEMENT

Revol Auctions (www.revolbids.live) is a real estate platform owned by REVOL REAL ESTATE, LLC and for the purposes of this Terms and Conditions Agreement, it will be referred to as “Revol Auctions”. We strive to provide a seamless and transparent auction experience for our users. Please read the following Terms and Conditions carefully before using our platform. REVOL AUCTIONS Terms and conditions and Privacy policy were updated on 04/03/2023.

By using this service, you acknowledge and agree to the terms, conditions, privacy policies, and restrictions as outlined in this User Agreement (“Agreement”). REVOL AUCTIONS reserves the right to modify these terms and conditions at any time.

What is REVOL AUCTIONS?

REVOL Auctions is a real estate marketing platform that is designed for real estate agents to engage sellers and connect them with buyer agents via marketplace. Modern auction technology promotes transparency and fairness in the selling process. Bidders participate on a level playing field, and the auction process is typically open and transparent, allowing all participants to see the bids in real-time. This creates a sense of fairness and trust among buyers, which can result in more competitive bidding and a higher sale price for the seller. Through a licensed subscriber a property can be marketed for sale on real estate websites and elect to receive offers through the REVOL Auction platform. The Auction offer platform is designed to enhance the communication and speed of which offers can be made between parties. No offer is considered accepted until the licensed subscriber, selling parties and buying parties have signed all required state documents.

REVOL Auction Terms of Use

By using REVOL Auctions, you are agreeing that you will abide by and follow all the terms and conditions of use as listed below.

  1. REVOL Auctions is a marketplace platform designed to be used by licensed real estate agents.
  2. Any and all information entered by parties is intended for use of Listing or purchasing a property and thatinformation shall not be used in any other way.
  3. Users shall not copy, redistribute or retransmit any of the information provided except in connection withthe purchase or sale of an individual property.
  4. In relation home listings or offers and contracts, all parties understand that additional agreements will berequired to proceed with listing a home or the purchase of a home.

Registration

REVOL Auctions requires that each user has a username and password, the combination of which is different for each user. REVOL Auction will ensure that any email address is only associated with one username and password.

You are responsible for all activities related to the Services that occur through your account and password. It is your responsibility to keep your profile information accurate. You agree to keep your password confidential, not use others’ accounts, nor permit others to use your account. REVOL Auction reserves the right to terminate accounts at its discretion.

Users are required to keep information entered REVOL Auction Platform accurate and deemed reliable.

Privacy Agreement

This Privacy Agreement (the “Agreement”) outlines the policies and practices of REVOL Real Estate (“REVOL”, “we”, “our”, or “us”) regarding the collection, use, and protection of personal information on our website (the “Website”). Offer Disclosure

The buyer acknowledges that the public disclosure of their offer is solely for the purpose of providing transparency in the real estate transaction process and does not guarantee acceptance of their offer or create any obligation on the part of the seller to accept or counter the offer.

The buyer understands that the public disclosure of their offer may be accessible to other potential buyers, competitors, or the general public, and may impact their negotiation position or confidentiality of their offer. The buyer should carefully consider the potential risks and benefits of public disclosure before submitting their offer.

The buyer agrees to hold harmless and indemnify the seller, the real estate agency, and their respective agents, officers, and employees from any claims, damages, or liabilities arising out of or related to the public disclosure of their offer, including but not limited to any claims of breach of confidentiality or violation of privacy.

The buyer acknowledges that the public disclosure of their offer may be subject to applicable laws and regulations, including but not limited to local real estate laws, privacy laws, and fair housing laws. The buyer is responsible for ensuring that their offer complies with all applicable laws and regulations.

The buyer understands that the public disclosure of their offer may be made through various online platforms or mediums, including but not limited to the real estate agency’s website, social media, and other online marketing channels. The buyer grants the real estate agency the right to disclose their offer in such online platforms or mediums for the purpose of providing transparency in the real estate transaction process.

The buyer acknowledges that the public disclosure of their offer may be subject to change, as new offers may be received or existing offers may be updated or withdrawn. The real estate agency will make reasonable efforts to update the public disclosure of offers in a timely manner, but cannot guarantee the accuracy or completeness of the information.

The buyer understands that the public disclosure of their offer does not waive their right to confidentiality or their ability to negotiate or revise their offer during the course of the real estate transaction. The buyer may request in writing to the real estate agency to remove or update the public disclosure of their offer, and the real estate agency will make reasonable efforts to accommodate such requests, subject to applicable laws and regulations.

These terms and conditions shall be binding upon the buyer, the seller, and the real estate agency, and their respective successors and assigns. Any amendments or modifications to these terms and conditions must be in writing and signed by all parties.

Security

REVOL Auction will employ reasonable efforts to monitor for, and prevent, misappropriation, “scraping”, and other unauthorized use of stored information.

Limitation of Liability

By using the REVOL Auction website (the “Website”), you acknowledge and agree to the following limitation of liability:

Dispute Resolution

If a dispute arises between REVOL Auctions and a user of the service, then both parties agree to resolve their dispute using an experienced mediator.

Auction Terms

Working with a licensed Real Estate Agent is required. Upon winning the bid, a signed contract on state or local contracts must be completed by a licensed Agent and must be submitted within 4 hours after the winning bid along with the earnest money deposited with an escrow agent. If not submitted in a timely manner- agent and seller reserve the right to engage and or accept other bids/ offers.

The agent representing the buyer is responsible for any questions on behalf of the buying party and explaining/ confirming the understanding of the bidding process and expenses related.

What is the “Buyers Premium” – Using our Home Auctions option, real estate commission can be paid by the seller, the buyer or both. The buyer’s side of the commission is called “Buyer’s Premium”. (Highest Bid + Buyer’s Premium = Sales Price)

Each property listed on our web site could offer different terms, conditions and buyers premium, so be sure to research the property and all of the details on the property bid page.

Property will be available for viewing only on the day(s) of the open house or per the showing instructions set by the seller (unless agreed otherwise).

Buyers must be approved for financing if involved prior to bidding. It is the agent representing the buyers who is responsible to confirm this.

Sellers reserve the right to accept, negotiate or reject the highest bid – at their sole discretion.

Terms You Should Know

Bidding Auto Extend – Our system Prevents Last Second Bidding by Automatically Extending the Bidding Time.

If a bidder places a bid within 3 minutes of the end of the bidding time, the system will automatically extend the bidding time by 2 minutes in order to allow other bidders the opportunity to respond.

Attention Winning Bidders

If You Are The Winning Bidder: Please have your agent submit a signed purchase agreement to the seller within the time specified in “sale terms and conditions”
